2. General conditions of use of the site and the services offered.

Use of the www.valfleuri.fr website implies full acceptance of the general conditions of use described below. These conditions of use may be modified or supplemented at any time, and users of the www.valfleuri.fr site are therefore advised to consult them regularly.

This site is normally accessible to users at all times. Valfleuri may, however, decide to interrupt the site for technical maintenance purposes, and will endeavour to inform users of the dates and times of such interventions in advance.

Any reproduction, representation, modification, publication or adaptation of all or part of the elements of the site, by whatever means or process, is forbidden without the prior written authorization of Valfleuri.

Any unauthorized use of the site or of any of the elements it contains will be considered as constituting an infringement and will be prosecuted in accordance with the provisions of articles L.335-2 et seq. of the French Intellectual Property Code.

6. Limitation of liability.

Valfleuri may not be held liable for direct or indirect damage caused to the user’s equipment when accessing the www.valfleuri.fr site, and resulting either from the use of equipment that does not meet the specifications indicated in point 4, or from the appearance of a bug or incompatibility.

Valfleuri cannot be held responsible for indirect damages (such as loss of business or loss of opportunity) resulting from use of the www.valfleuri.fr website.

Interactive areas (possibility to ask questions in the contact area) are available to users. Valfleuri reserves the right to delete, without prior notice, any content posted in this area that contravenes French legislation, in particular provisions relating to data protection. Where applicable, Valfleuri also reserves the right to hold the user civilly and/or criminally liable, particularly in the event of messages of a racist, insulting, defamatory or pornographic nature, whatever the medium used (text, photographs, etc.).

7. Personal data management.

In France, personal data is protected by law no. 78-87 of January 6, 1978, law no. 2004-801 of August 6, 2004, article L. 226-13 of the Criminal Code and the European Directive of October 24, 1995.

When using the www.valfleuri.fr site, the following information may be collected: the URL of the links via which the user accessed the www.valfleuri.fr site, the user’s access provider, the user’s Internet protocol (IP) address.

In any case, Valfleuri only collects personal information relating to the user for the purpose of certain services offered by the www.valfleuri.fr website. Cookie lifetimes

As consent to be tracked can be forgotten by those who have given it at a given moment, the CNIL considers it necessary to limit the scope of this consent over time.

  • It recommends that the period of validity of consent to the deposit of Cookies be extended to a maximum of 13 months. At the end of this period, consent must be obtained again.
  • As a result, cookies should have a lifetime limited to thirteen months after their first deposit in the user’s terminal equipment (following the expression of consent).
  • Their lifetime must not be extended during subsequent visits to the site.

Penalties for non-compliance with the identification obligation

Failure to make these legal notices available to the public is punishable by one year’s imprisonment and a fine of 75,000 euros (article 6 of law 2004-575 of June 21, 2004).

Legal entities are liable to a fine of 375,000 euros and a ban, for a period of up to 5 years, on directly or indirectly carrying on the professional activity in the exercise or on the occasion of which the offence was committed.

They may also be ordered to display or circulate the conviction. Failure to comply with the obligations set out in Act 78-17 of January 6, 1978, in connection with the processing of information gathered, is punishable in accordance with the provisions of articles 45 et seq. of the same Act.

9. Applicable law and attribution of jurisdiction.

Any dispute relating to the use of the site www.valfleuri.fr is subject to French law.

In accordance with Article R 631-3 of the Consumer Code, the consumer may, at his choice, refer the matter to one of the courts with territorial jurisdiction under the Code of Civil Procedure, the court of the place where he was living at the time of the conclusion of the contract or the occurrence of the damaging event.
